劳动法基本原则法定化研究

摘要:
学界对劳动法基本原则的认识存在很大的分歧,有各种主张,一时之间较难取得一致认识。而劳动法基本原则十分重要,有必要将其明文规定。劳动法基本原则法定化,是完备劳动法律规范体系的需要,也有利于准确、公正地指导劳动法的实施。将劳动法基本原则法定化,也是大陆法系国家通行的做法。结合法律原则的特征和构成条件,劳动自由原则、禁止强迫劳动原则、禁止劳动歧视原则和三方协商四项原则在将来《劳动法》修改时应明文加以规定,予以法定化。

Abstract:
There are many differences in the understanding of the basic principles of Labor Law in academic circle, and it is not easy to reach a consensus in a short period. These basic principles are very important, so it is necessary to legalize them, which is not only one of the requirements for completing Labor Law and norm system, but also a favorable factor to guide the implementation of Labor Law correctly and fairly. In addition, the legalization is a common practice in civil law countries. According to legal principles’ characteristics and constituting requisites, the four principles, namely labor freedom, no forced labor, no labor discrimination and tripartite negotiation should be prescribed and legalized in the amendment of Labor Law in the future.
